General Terms and Conditions

General Terms and Conditions and consumer information in the context of purchase contracts concluded via the online store between Infinity Flowerbox GmbH - hereinafter referred to as "Seller" - and the customer - hereinafter referred to as "Consumer".

§1 General Terms and Conditions

The following General Terms and Conditions apply to all contracts that you conclude with us as the provider, Infinity Flowerbox GmbH, via our domain - available at infinity-flowerbox.com.

Unless otherwise agreed, the inclusion of your own terms and conditions, if any, is contradicted. Contractual partners within the framework of the conclusion of the contract are exclusively Infinity Flowerbox GmbH and the ordering customer.
The customer is a consumer if he concludes the contract for purposes that can predominantly be attributed neither to his commercial nor his independent professional activity.
An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

§2 Conclusion of contract

1. the contract is concluded with: Infinity Flowerbox GmbH, Doebelner Str. 1 , 12627 Berlin
2. The mere presentation of our goods in our online store does not constitute a legally binding contractual offer by Infinity Flowerbox GmbH, but is a non-binding invitation to place an order
3. All orders placed by the consumer are subject to acceptance by Infinity Flowerbox GmbH and the availability of the goods. By placing an order you make a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by e-mail or by delivering the ordered goods.
4. When ordering via our online store, the ordering process comprises a total of 10 steps, which are made up as follows:

1. one of our product links on the main page takes the consumer to the detailed view of the respective products.

2. here the consumer selects the size and color of the box, as well as the color of the roses.

3. by confirming the button ''add to shopping cart'', the previously selected product is added to the consumer's shopping cart.

4. the consumer now has the option of adding further products to his shopping cart.

5. if the consumer wishes to complete their purchase, they can click on the "Proceed to checkout" button to access an overview of their previously selected items. Here the consumer can check his purchase again and correct it if necessary (change the number of items, delete items, etc.) and/or have a greeting card attached to his order by using the white input box.

6. by confirming the ''checkout'' button, the consumer is taken to the payment page, where he can see his ordered items again on the right-hand side and must enter his email (for order confirmation) and the delivery address of the products on the left-hand side.

7. by confirming the ''Shipping method'' button, the consumer is taken to the shipping page. Here the delivery address can be changed again if necessary and the delivery method selected.

8. by confirming the ''Payment method'' button, the consumer is taken to the payment page where he has the option of selecting his preferred payment method. The following payment methods are available: PayPal, credit card, advance payment and instant bank transfer.

9. by clicking the "buy" button, the consumer sends his order to us. By sending the order via the "buy" button, the consumer declares acceptance of the offer in a legally binding manner, whereby the purchase contract is concluded.

10 First, the consumer receives a confirmation of receipt of the order by e-mail to the e-mail address provided by him (order confirmation). However, a purchase contract is only concluded when our order confirmation is sent to the consumer by e-mail or when the ordered goods are delivered.

§3 Payment

1. all prices are final prices, they include the statutory VAT
2. Payment can be made by instant bank transfer, credit card, prepayment, PayPal, Amazon Pay or Apple Pay. We reserve the right to exclude individual payment methods
3. Payment of the purchase price is due immediately upon conclusion of the contract.

§4 Delivery conditions and shipping

1. delivery will only be made after receipt of the full purchase price.
2. deliveries of our articles can only be made within the EU and Switzerland
3. For deliveries within the Federal Republic of Germany, shipping costs of 4.50 euros will be charged.
4. The shipping costs for deliveries to other EU countries and Switzerland are calculated at a flat rate of 14.90 euros per order.
5. The service is provided in Berlin.

§5 Retention of title

The goods remain the property of Infinity Flowerbox GmbH until full payment has been received.

§6 Liability

1. we shall be liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB), in the event of intent or gross negligence
2. Furthermore, we are liable without limitation for injury to life, limb or health
3. If a breach of material contractual obligations is due to slight negligence, our liability shall be limited to the foreseeable damage typical of the contract. Essential contractual obligations are those which arise from the nature of the contract and whose fulfillment is essential for the proper execution of the contract and whose compliance the consumer may regularly rely on.
4. Insofar as contractual obligations have been violated insignificantly, liability for slightly negligent breaches of duty is excluded.

§7 Applicable law

1. German law applies exclusively to all disputes arising from the contractual relationship between the consumer and Infinity Flowerbox GmbH.
2. The provisions of the UN Convention on Contracts for the International Sale of Goods are excluded and do not apply.

§8 Right of withdrawal for consumers

Consumers have a fourteen-day right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise the right to cancel, you must inform us (Infinity Flowerbox GmbH, Doebelner Str. 1 , 12627 Berlin, Deutschland, contact@infinity-flowerbox.com, Phone: 0174 3110243) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Excluded from the right of withdrawal are, according to Art. 16 lit. c) of Directive 2011/83/EU (§312g Para. 2 No. 1 BGB), orders for products that have been individually manufactured on request are excluded from the right of withdrawal. For example, color mixes that are not regularly listed in the range, as well as boxes with engraving or greeting cards inscribed with a text of your choice, which are then unsuitable for resale.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
