General Terms and Conditions

General terms and conditions and consumer information within the framework of purchase agreements concluded via the online shop between Infinity Flowerbox GmbH – hereinafter referred to as "Seller" – and the customer - hereinafter referred to as "Consumer".

§1. General Terms and Conditions

The following General Terms and Conditions apply to all contracts concluded with us as the provider, Infinity Flowerbox GmbH, via our domain – accessible at infinity-flowerbox.com.

Unless otherwise agreed, the inclusion of any own conditions used by you is rejected. The contracting parties within the framework of the conclusion of the contract are exclusively Infinity Flowerbox GmbH and the ordering customer. The customer is a consumer if they conclude the contract for purposes that cannot be predominantly attributed to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

§2. Conclusion of Contract

1. The contract is concluded with: Infinity Flowerbox GmbH, Doebelner Str. 1, 12627 Berlin 2. The mere presentation of our goods in our online shop does not constitute a legally binding contractual offer from Infinity Flowerbox GmbH, but is a non-binding invitation to place an order. 3. All orders from the consumer are subject to acceptance by Infinity Flowerbox GmbH and the availability of the goods. By placing an order, you submit a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by email or by delivering the ordered goods. 4. When ordering via our online shop, the order process comprises a total of 10 steps, which are structured as follows:

1. The consumer reaches the detailed view of the respective products via one of our product links on the main page.

2. Here, the consumer selects the size and color of the box, as well as the color of the roses.

3. By confirming the button ''add to shopping cart'', the previously selected product is placed in the consumer's shopping cart.

4. Now the consumer has the option to add more products to their shopping cart.

5. If the consumer wants to complete their purchase, they can click the ''go to checkout'' button to reach an overview of their previously selected items. Here, the consumer can check their purchase again and correct it if necessary (change the number of items, delete items, etc.) and/or add a greeting card to their order by using the white input box.

6. By confirming the ''go to checkout'' button, the consumer reaches the payment page, where they see their ordered items again on the right-hand side and must enter their email (for order confirmation) and the delivery address of the products on the left-hand side.

7. By confirming the ''shipping method'' button, the consumer reaches the shipping page. Here, the delivery address can be changed again if necessary, and the delivery method can be selected.

8. By confirming the ''payment method'' button, the consumer reaches the payment page, where they have the option to select their preferred payment method. The payment methods available are PayPal, credit card, prepayment and instant transfer.

9. By clicking the "buy" button, the consumer sends their order to us. By submitting the order via the "buy" button, the consumer legally declares the acceptance of the offer, whereby the purchase contract is concluded.

10. First, the consumer receives a confirmation of receipt of the order by email to the email address they provided (order confirmation). However, a purchase contract is only concluded when we send our order confirmation to the consumer by email or when the ordered goods are delivered.

§3. Payment

1. All prices are final prices and include the statutory value added tax. 2. Payment is made optionally by instant transfer, credit card, prepayment, PayPal, Amazon Pay or Apple Pay. We reserve the right to exclude individual payment methods. 3. The payment of the purchase price is due immediately upon conclusion of the contract.

§4. Delivery Conditions and Shipping

1. Delivery will only take place after receipt of the full purchase price. 2. Deliveries of our items can only be made within the EU and Switzerland. 3. For deliveries within the Federal Republic of Germany, shipping costs of 4.50 euros apply. 4. The shipping costs for deliveries to other EU countries and Switzerland are a flat rate of 14.90 euros per order. 5. The service is provided in Berlin.

§5. Retention of Title

The goods remain the property of Infinity Flowerbox GmbH until full payment has been received.

§6. Liability

1. We are liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff BGB, in the event of intent or gross negligence. 2. Furthermore, we are liable without limitation for injury to life, limb or health. 3. Should a breach of essential contractual obligations be based on slight negligence, our liability shall be limited to the contractually typical, foreseeable damage. Essential contractual obligations are those that arise from the nature of the contract and whose fulfillment is essential for the proper execution of the contract and whose compliance the consumer may regularly trust. 4. Insofar as contractual obligations have been insignificantly violated, liability for slightly negligent breaches of duty is excluded.

§7. Applicable Law

1. All disputes arising from the contractual relationship between the consumer and Infinity Flowerbox GmbH shall be governed exclusively by German law. 2. The provisions of the UN Convention on Contracts for the International Sale of Goods are excluded and do not apply.

§8. Right of Withdrawal for Consumers

Consumers have a fourteen-day right of withdrawal.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Infinity Flowerbox GmbH, Doebelner Str. 1, 12627 Berlin, Germany, contact@infinity-flowerbox.com, Telephone: 0174 3110243) by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

According to Art. 16 letter c) of Directive 2011/83/EU (§312g para. 2 no. 1 BGB), orders for products that were individually manufactured according to your wishes are excluded from the right of withdrawal. This includes, for example, color mixtures that are not regularly listed in the range, as well as boxes with engraving or greeting cards with personalized text that are then impossible to resell.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the nature, properties and functionality of the goods.

The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/. We are willing to participate in an out-of-court arbitration procedure.
